The Town has an ordinance that regulates the manner, location, time and amount of vending on private and public property including the Highway 145 spur. Vending is defined as selling goods or services outside of a building. If you have specific questions, please refer to staff names and phone numbers.
The following information is intended to be an overview of vending in Telluride.
Activities Allowed Without a Permit
- Free music or entertainment
- Free distribution of information, flyers, pamphlets, brochures or petitions
- Display of advertising on a carried sandwich board
- Individual or group yard sales at any one location not exceeding three consecutive days in duration and totaling not more than eight days a year
- Sales by children under the age of fourteen years of age with items for sale at a cost of a maximum of $3.00 an item
- Use of the permanent table next to the kiosk on the corner of Colorado and Pine by nonprofit organizations
Vending on Public Sites:
- Is allowed in designated areas, by permit
- General vending on two spaces on the sidewalk by the courthouse (North Oak Street Mall)
- General vending on two spaces next to Elks Park (South Oak Street Mall)
- General vending on one space next to the Gondola Plaza
- One mobile vendor is allowed to sell food and non-alcoholic beverages from a non-motorized device, wagon, cart, tray or basket on public rights of way
- North Spruce Street Market vending of fruits and vegetables on the mall
- Tents are not allowed
- Display apparatus is to be removed from public property at the end of each working day.
Vending on Private Sites:
- Is allowed on private property only in designated areas and by permit
- There is short term (festival) and long term vending allowed
- Owner permission is required
General Guidelines:
- Complete vending rules and regulations are found in the Telluride Municipal Code at Sec. 6, Article 4
- Permits are required when vending on private or public property. State of Colorado health permits are required for food vendors as well as commercial kitchens.
- Indemnification and liability insurance are required
- There are size limitations for carts. Tents are only allowed for short term vending on private property
- Signage shall be painted on or attached to the display apparatus/cart. There are size limitations on signage
- Other licenses are required i.e. business licenses, sales tax etc.
- The use of generators is not allowed
- Vending permits are non transferable
Application Process:
- Applications are filed with the Town Clerk’s office at Town Hall, 135 W. Columbia, P.O. Box 397, Telluride. Click here for the application.
- Permits for the public sites are issued for a season
- Application deadlines (for public sites) are accepted from January 2 until March 13th for 2009 summer vending and from June 1st until August 14th for 2009/10 winter vending.
- Vendors (for public sites) are selected by a point system using: prior vending history in Telluride; diversity of offered food, goods, wares, merchandise or services; the appearance, quality of, safety and attractiveness of the display apparatus.

The Town of Telluride is accepting applications for a limited number of vending sites for the 2009/10 WinterVending Season beginning October 15.
