San Miguel County, Town of Telluride Respond to Offer on Diamond Ridge Property


(December 20, 2023) – Telluride, CO --- The Managers of San Miguel County and the Town of Telluride responded to parties that recently submitted an unsolicited offer on the 105-acre Diamond Ridge parcel, jointly owned by San Miguel County and the Town of Telluride. The parcel, which is adjacent to the Telluride Regional Airport, was purchased by the local governments in 2022 for $7.21M with the intention of developing a maximum of 240 deed-restricted housing units on approximately 27 acres of the property. 

On December 5, 2023, Mr. Dirk de Pagter and Mr. Nicholas Farkouh submitted an unsolicited purchase offer through Telluride Real Estate Brokers, Inc. in the amount of $6.15M for the property. Mr. de Pagter and Mr. Farkouh are residents of San Miguel County and are listed as plaintiffs in active litigation against the County and Town related to the rezoning of the parcel from Forestry/Agriculture to Community Housing. 

The San Miguel County Manager and Telluride Town Manager jointly responded to Mr. de Pagter and Mr. Farkouh, declining their offer.  

The response explained, “…the San Miguel County Commissioners and the Telluride Town Council met separately in publicly advertised Executive Sessions on this matter and both bodies have determined that it is not fiscally responsible to entertain unsolicited offers for purchase of public property. The County and the Town remain community partners regarding this property. In the future, if the County Commissioners and the Telluride Town Council determine it is in the public’s interest to sell the Diamond Ridge property, it would be offered publicly in a competitive bid process to ensure transparency, fair competition, and comprehensive consideration in line with local government fiduciary duties.”

There is no current plan by the local governments to sell the Diamond Ridge property. Various options as to how to move forward are being considered.

Prior to Mr. de Pagter and Mr. Farkouh’s offer on the Diamond Ridge property, a previous unsolicited offer was received by the local governments in October 2023 from Ms. Pamela Bennett through Telluride Real Estate Brokers, Inc. for an amount of $6.3M. However, the offer was withdrawn in November 2023 before consideration by San Miguel County or the Town of Telluride. Ms. Bennett, a San Miguel County resident, was also a plaintiff in the lawsuit against the County and Town in the Diamond Ridge matter. Plaintiffs have filed a Notice of Appeal to the Colorado Court of Appeals.

El Condado de San Miguel y el Pueblo de Telluride responden a la oferta sobre la propiedad de Diamond Ridge

(20 de diciembre de 2023) - Telluride, CO --- Los Gerentes del Condado de San Miguel y del Pueblo de Telluride respondieron a las partes que recientemente presentaron una oferta no solicitada sobre la parcela de 105 acres Diamond Ridge, propiedad conjunta del Condado de San Miguel y del Pueblo de Telluride. La parcela, que es adyacente al Aeropuerto Regional de Telluride, fue adquirida por los gobiernos locales en 2022 por $ 7.21M con la intención de desarrollar un máximo de 240 unidades de vivienda con restricciones de escritura en aproximadamente 27 acres de la propiedad. 

El 5 de diciembre de 2023, el Sr. Dirk de Pagter y el Sr. Nicholas Farkouh presentaron una oferta de compra no solicitada a través de Telluride Real Estate Brokers, Inc. por valor de 6,15 millones de dólares por la propiedad. El Sr. de Pagter y el Sr. Farkouh residen en el condado de San Miguel y figuran como demandantes en un litigio activo contra el condado y la ciudad en relación con la recalificación de la parcela de Silvicultura/Agricultura a Vivienda Comunitaria. 

El administrador del condado de San Miguel y el administrador municipal de Telluride respondieron conjuntamente al Sr. de Pagter y al Sr. Farkouh rechazando su oferta.  

La respuesta explicaba: "...los Comisionados del Condado de San Miguel y el Ayuntamiento de Telluride se reunieron por separado en sesiones ejecutivas anunciadas públicamente sobre este asunto y ambos órganos han determinado que no es fiscalmente responsable considerar ofertas no solicitadas para la compra de propiedad pública. El condado y la ciudad siguen siendo socios comunitarios en lo que respecta a esta propiedad. En el futuro, si los Comisionados del Condado y el Ayuntamiento de Telluride determinan que es de interés público vender la propiedad de Diamond Ridge, se ofrecería públicamente en un proceso de licitación competitivo para garantizar la transparencia, la competencia leal y la consideración integral en consonancia con los deberes fiduciarios del gobierno local."

Actualmente, las administraciones locales no tienen previsto vender la propiedad de Diamond Ridge. Se están estudiando varias opciones para seguir adelante.

Antes de la oferta del Sr. de Pagter y el Sr. Farkouh sobre la propiedad de Diamond Ridge, los gobiernos locales recibieron una oferta previa no solicitada en octubre de 2023 de la Sra. Pamela Bennett a través de Telluride Real Estate Brokers, Inc. por un importe de 6,3 millones de dólares.
