Mayor Finds No Grounds for Disqualification in Housing Authority Commissioner Complaint

Decision recommends further examination of THA composition to enhance public participation and decision-making

(July 2, 2024) – Telluride, CO --- The Mayor of the Town of Telluride, Teddy Errico, has issued a formal decision regarding an ethics complaint filed against Telluride Housing Authority (THA) Commissioner Dan Enright. The conclusion determined that there are no grounds to remove THA Commissioner Dan Enright from the THA Board. 

The complaint, submitted on June 3, 2024, by fellow THA Commissioner and Town Councilperson Ashley Story Von Spreecken, called for the removal of Enright for alleged misconduct related to his failure to disclose his interest in the Shandoka project via his residential lease. CRS Section 29-4-207 mandates that commissioners disclose if they either own or control an interest, direct or indirect, in any property included or planned to be included in any housing authority project.

On June 17, 2024, a public hearing was convened to address the complaint. Commissioner Enright was represented by legal counsel Geoff Wilson. After careful consideration, Mayor Errico concluded that the complaint did not warrant Enright's removal from the THA.

Mayor Errico's decision was based on several key findings:

  • Commissioner Enright does not own any interest in the Shandoka project, only holding a limited residential lease.
  • A lease does not constitute "controlling an interest" in the project as per CRS Section 29-4-207.
  • Disqualifying commissioners based on a lease tenancy would unduly limit the participation of those directly assisted by the authority, contrary to CRS Section 29-4-205(3.5).
  • Mayor Errico emphasized the importance of open communication among THA members to avoid adversarial situations and praised Commissioner Enright's professional conduct throughout the proceedings. 

“This is an unfortunate situation having a THA Commissioner file a formal and quite serious complaint asking for removal and significant consequences against a fellow THA Commissioner,” stated Mayor Errico. “At no time prior to the formal filing of the Von Spreecken Complaint was I aware of Ms. Von Spreecken’s dismay with Mr. Enright. If this matter was raised to my attention in advance, I would have scheduled a work session to discuss the matter in an attempt to avoid the serious implications and tension created by having a public hearing on an allegation of misconduct.”

The Mayor also suggested that the THA and the Town of Telluride examine the composition of the Housing Authority to enhance public participation and decision-making.

The complaint and decision follow the conclusion of another series of allegations regarding potential violations of the Town's Ethics Code, culminating in an Advisory Opinion issued by the Town Clerk on May 29. The opinion concluded that the questions submitted by Complainants Todd Creel, Emily Masson, and Charles Price regarding Dan Enright as a member of the Telluride Housing Authority did not fall within the scope of the Town Ethics Code, and thus, no opinion would be issued on that matter.

El alcalde no encuentra motivos de inhabilitación en la denuncia contra el comisario de la Autoridad de la Vivienda

La decisión recomienda un examen más detenido de la composición de THA para mejorar la participación pública y la toma de decisiones

(2 de julio de 2024) - Telluride, CO --- El alcalde de la ciudad de Telluride, Teddy Errico, ha emitido una decisión formal en relación con una denuncia de ética presentada contra Telluride Housing Authority (THA) Comisionado Dan Enright. La conclusión determinó que no hay motivos para destituir al Comisionado de THA Dan Enright de la Junta de THA. 

La denuncia, presentada el 3 de junio de 2024 por la también comisionada de la THA y concejala Ashley Story Von Spreecken, pedía la destitución de Enright por supuesta mala conducta relacionada con no haber revelado su interés en el proyecto Shandoka a través de su contrato de arrendamiento de vivienda. El artículo 29-4-207 del CRS obliga a los comisionados a revelar si poseen o controlan un interés, directo o indirecto, en cualquier propiedad incluida o que se prevea incluir en cualquier proyecto de la autoridad de vivienda.

El 17 de junio de 2024, se convocó una audiencia pública para tratar la queja. Comisionado Enright estuvo representado por el asesor legal, Geoff Wilson. Después de una cuidadosa consideración, el alcalde Errico concluyó que la queja no justificaba la destitución de Enright de la THA.

La decisión del alcalde Errico se basó en varias conclusiones clave:

  • El Comisario Enright no posee ningún interés en el proyecto Shandoka, sino que sólo es titular de un arrendamiento residencial limitado.
  • Un arrendamiento no constituye "controlar un interés" en el proyecto según la sección 29-4-207 del CRS.
  • La descalificación de los comisarios basada en un arrendamiento limitaría indebidamente la participación de las personas directamente asistidas por la autoridad, en contra de lo dispuesto en el artículo 29-4-205(3.5) del CRS.
  • El alcalde Errico hizo hincapié en la importancia de la comunicación abierta entre los miembros del THA para evitar situaciones de confrontación y elogió la conducta profesional del comisario Enright durante todo el procedimiento.

"Esta es una situación desafortunada tener un THA Comisionado presentar una queja formal y bastante grave pidiendo la remoción y consecuencias significativas en contra de un compañero THA Comisionado", declaró el alcalde Errico. "En ningún momento antes de la presentación formal de la queja de Von Spreecken tuve conocimiento del malestar de la Sra. Von Spreecken con el Sr. Enright. Si este asunto se hubiera planteado a mi atención con antelación, habría programado una sesión de trabajo para discutir el asunto en un intento de evitar las graves implicaciones y la tensión creada por tener una audiencia pública sobre una acusación de mala conducta."

El Alcalde también sugirió que la THA y el Ayuntamiento de Telluride examinaran la composición de la Autoridad de la Vivienda para mejorar la participación pública y la toma de decisiones.

La denuncia y la decisión siguen a la conclusión de otra serie de alegaciones relativas a posibles infracciones del Código Ético Municipal, que culminaron en un Dictamen Consultivo emitido por el Secretario Municipal el 29 de mayo. El dictamen concluía que las preguntas presentadas por los denunciantes Todd Creel, Emily Masson y Charles Price en relación con Dan Enright como miembro de la Autoridad de la Vivienda de Telluride no entraban en el ámbito de aplicación del Código Ético Municipal, por lo que no se emitiría dictamen alguno al respecto.
